Pipeline developers appeal New York permit rejection




ALBAN Y, N.Y. (AP) Constitution Pipeline Company has appealed New York’s denial of a critical permit and asked a federal court to take away the state’s permitting authority for the project.

The state Department of Environmental Conservation last month denied a water quality permit for the 124-mile pipeline from Pennsylvania’s shale fields to eastern New York. The Federal Energy Regulatory Commission approved the project in December 2014 conditioned on the state permit.

The DEC said the project failed to meet standards to protect streams, wetlands and other water resources.

The appeal filed Monday with the U.S. Circuit Court of Appeals contends the state’s refusal is arbitrary and capricious.

A DEC spokesman said the agency doesn’t comment on pending litigation.
